New Client Background Information
Under the provisions of the Fair Credit Reporting Act of 1996, the Consumer Reporting Employment Clarification Act of 1998, the Fair and Accurate Transactions Act of 2003, ABS’ Privacy Policy and the sensitive nature of Employment Consumer Reports, a due diligence background investigation will be conducted on new client organizations. This is to ensure only authorized personnel order and review sensitive personal information on consumer-applicants.

SUBSCRIBER CERTIFICATION OF USE FOR EMPLOYMENT SCREENING CONSUMER REPORTS
In compliance with the Federal Fair Credit Reporting Act of 1996 (the “Act”),

hereby certifies to American Business Services that it will comply with the following provisions:

1. Subscriber will ensure that prior to procurement or causing the procurement of a consumer report for employment purposes(an ABS employment report):
a) a clear and conspicuous disclosure has been made in writing to the consumer (applicant) at any time before the report is procured or caused to be procured, in a document that consists solely of the disclosure, that a consumer report may be obtained for employment purposes; and
b) the consumer has authorized in writing the procurement of the report by the Subscriber.

2. In using a consumer report for employment purposes, before taking any adverse action, based in whole or in part on the contents of the report, the Subscriber shall provide to the consumer to whom the report relates:
a) a copy of the report; and
b) a description in writing of the rights of the consumer under the Act, a copy of which is attached hereto (Summary of a Consumer’s Rights under the Fair Credit Reporting Act).

3. The information from the consumer report will not be used in violation of any applicable federal or state equal employment opportunity law or regulation. Subscriber hereby acknowledges receipt of the Summary of Consumer Rights.

Consumer Report Service Agreement
In order to cooperate with other business and professional people in the confidential dissemination of credit and related personal employment information, the undersigned Client (End User of Consumer Reports) enters into this service contract with American Business Services (Consumer Reporting Agency).

Client Certifies and Agrees:
The Client will comply with all the provisions of Public Law 91-508 (Fair Credit Reporting Act) and all other applicable statutes, both state and federal. Client certifies that it will request consumer reports for the permissible purpose certified below and will not use the reports for any other purpose.
For employment purposes

Reports will be requested by Client’s designated representatives and employees will not obtain reports on themselves, associates or other person except in exercise of their official duties. All written authorizations will be maintained for a minimum of three (3) years. Client shall use the Consumer Report for a one-time use, hold the report in strict confidence and not disclose it to any third parties. Under no circumstances is a Consumer Report to be resold.

ABS Certifies and Agrees:
ABS will comply with the FCRA, all applicable statutes and will maintain complete confidentiality of Client’s employees, applicants and business. ABS will assemble and accurately report files, records and information that are required to complete Consumer Reports requested by Client for permissible purposes. ABS will obtain this information in good faith from sources provided by the Client, Consumer, Governmental Agencies and other reliable Consumer Reporting Agencies.

ABS’ professional fees will be provided in writing to the Client and are guaranteed not to increase for one year from the date of this contract. After one year, any increase of professional fees will be provided in writing 30 days prior to taking effect. Records fees and/or taxes are added to ABS’ professional fees and are subject to increase without notice.

Client and ABS Mutually Agree:
Client and ABS shall each be liable to any third party claimant for its own acts of negligence with regard to the performance of its duties and each shall indemnify and hold harmless the other from all such third party claims, costs and expenses arising from negligence or failure to perform any of its obligations including reasonable attorney’s fees.

Client is a  (enter business type) and has a permissible purpose for obtaining consumer reports as defined by Section 604 of the Federal Fair Credit Reporting Act (15 USC 1681b) as amended by the Consumer Credit Reporting Act of 1996.
